from what some of my friends (who attended local Unis) tell me, YES.....apparently these students have to sign some document called "Aku Berjanji" upon entering the Uni.

Boss, Our police are trigger-happy to shoot first and investigate later. The biggest lie was the police said there was a 'parang' in the car.After killing the driver, they were shocked to find the only survivor was another teenager so they pukul, tendang and pijak the poor boy.
Had it been an indian group in the car, the police would celebrate as if they have solved all unsolved criminal cases in selangor.Hence justify labelling any indian suspect as a wanted criminal. Sad day, a malay family is on the receiving end this time ! Bad luck they are also UMNO people.Sometime back when PAS supporters complain about police beating their family members, nobody took any notice as it is common thing in our police- stations.I envy policemen who get promoted instantly everytime they shoot innocent suspects without any proof.
We need to increase their pay again !

while i do not deny the fact that there has to be stricter rules pertaining to the discharge of firearms by the police, we should not look at this incident from one perspective. a 15-year-old has no business being behind the wheel of a car which he allegedly drove out of the family house at 2am. to make matters worse he allegedly tried to reverse into the cops when cornered. where is the family's responsibility here. from the news reports and the comments mentioned, one forms the conclusion that this 15-year-old has been driving for quite sometime. it certainly wasn't his first time being behind the wheel of car. now, if he can sneak out of the house at 2am and drive a car, what is there to prevent this young man from having a parang in the car without the family members' knowledge. then again, it could have belonged to his friend who bolted from the car???

whatever the outcome, there are 2 parties are equally at fault here.
very unfortunate incident indeed.
perhaps what is certain is that there needs to be firmer regulations pertaining to the discharge of firearms - such as not to shoot unless the suspect is confirmed armed. this is something for the law enforcement authorities to dwell on. being an ardent fan of police-based tv programmes on astro, the cop could have just moved out of the way when the suspect was reversing and then continue with the car chase and perhaps rammed the vehicle off the road when the opportunity presented itself later.

parents/custodians should also be more responsible. you see more nd more underage teenagers driving today. they are no longer confined to riding motorcycles in the kampung and this phenomena is extremely dangerous. check the newspapers for the number of accidents and fatalities involving underaged drivers this year and you will see what i mean. again i say, a 15 year old has no business driving. in this case, the boy was shot dead. in other cases, the driver killed other innocent motorists in accidents. to me this is of the same severity.

this is not a political issue but a socially-threatening one.

On Monday, I went to my son's school to give something to a teacher. She told me that one of my son's classmates came to her early in the morning, sobbing. It turned out the deceased was his friend and neighbour. He asked for permission to organize a tahlil session. I was still in the teachers' room when the boy came, this time bearing a donation box. So I am very very convinced that the late Aminul might have his naughty moments but a penjenayah, he couldn't have been.

Ya, scumbag racist Itchybrahim, why are you so quiet about this killing when you claim to fight for Malay rights? Is it because you are also fighting for the rights of the 1PIG and his trigger happy 1PDRM stooges?

Also why the infamous Shah Alam Cow Head Protestors Association so quiet. This Cow Head Association should be protesting in front of the 1PIG's office with an appropriate animal's head to demonstrate their anger and displeasure of the killing. Perhaps they could not find a suitable animal's head to represent the stupidity of the 1PG and 1PDRM. If this is the case, perhaps they can use the Itchybrahim's picture since the scumbag racist is the best description of a stupid brain dead animal.

Why is Hindraf also silent on this? Maybe the victim is not an Hindu Indian????

Justice must be seen to be done

“Justice should be seen to be done” is not a term in law which should be taken lightly.

What it means is quite simply is that, the public needs to see justice done or they will feel that the system is failing them. The whole validity of the justice system is based on the public’s consent to justice served.

Gerald Latouche is a magistrate in the United Kingdom. He was born in Dominica and attended the St Mary's Academy.

R -v- Sussex Justices, Ex parte McCarthy ([1924] [1923] All ER Rep 233) is a leading case famous for its precedence in establishing the principle that the mere appearance of bias is sufficient to overturn a judicial decision.

For those who have forgotten the meaning of bias it still means: prejudice, partiality, inclination, leaning, bent, disposition, propensity, tendency, predilection, unfairness, proclivity, preconceived notion, foregone conclusion, favoritism, predisposition, preconception, susceptibility. I could go on but simply put, it is to affect unduly or unfairly.

The often cited aphorism of Lord Hewart from the McCarthy case, that “… it is not merely of some importance but is of fundamental importance, that justice should not only be done, but should manifestly and undoubtedly be seen to be done,” is a paramount principle of the Rule of Law.

And at this moment, at the dawn of our 31st Independence Anniversary, requires some serious consideration by all citizens of the Commonwealth of Dominica.

Lord Chief Justice Hewart, in this expression, encapsulates a principle that had been long known and often expressed and brought into common parlance the expression...

"Not only must Justice be done; it must also be seen to be done."

Implicit in this aphorism is the public’s consent of justice served: the public’s satisfaction, the public’s approval, the public’s agreement that justice has been delivered – a sense of fairness, honesty, equality, equity and consistency before the law - that the law is just and that justice has been done.

Those persons responsible for representing, upholding, shaping, serving and dispensing justice in Dominica must ensure that the public consents – this is not to say that the public must agree with every decision of the courts or that the courts’ decision must be pleasing to the public – it simply means that the public sees that justice is done and equality and fairness before the law prevail.

Such is our responsibility; that we must be neither complacent nor arrogant in that duty. For this reason more than any we must be consistent! All must sing from the same hymn sheet.

The public must not be witness to the magistrates at war amongst themselves – the prison at war with the courts – the Public Prosecution at war with defendants – the police switching cases - the legal system in total public disarray – and the justice system being brought into disrepute!

These matters are being played out on talk shows, newspapers, websites and any other available media, but one wonders how many meetings if any are held between the parties to resolve the issues. How many directives if any are sent down from the Ministry of Justice or the responsible Government Department, to resolve these issues?

The public perception of unscrupulous, corrupt, and dishonourable practices within any branch of the Justice System; the police, the courts, the magistrates, justice departments … can only serve to undermine and corrupt the conventional public’s view of justice being seen to be done.

I fear that we are on the verge of such a tragedy in the Commonwealth of Dominica."Unquote.
