CONSPICUOUSLY INCONSPICUOUS.

I mean the exclusion of these two giants. Sri Ram and Justice Malanjum,  both icons of integrity were conveniently SIDELINED. Not only were they not on the RESERVE BENCH, they were not on the LIST. Maybe these two do not belong to the elite TEAM subservient to the powers.

Royally ousted Perak Menteri Besar Mohd Nizar Jamaluddin's final appeal at the Federal Court would  be closely watched as the reputation of the judiciary is at stake.

There was of course a speck of decency not appointing Augustine Paul, deemed superfluous, as he specializes in “rear admiral” cases only as in this case nobody got buggered from the rear. Dang, maybe I am wrong…..my home state got “reared” bad. However word has it that he is being “cloistered and coached” for BIGGER decisions to save some unisex tag team!

President of Court of Appeal Alauddin Mohd Sheriff and Chief Judge of Malaya Arifin Zakaria have been permanent fixtures in handling all Perak cases that comes before the Federal Court, are conspicuous and seemingly indispensable for this particular case. Undoubtedly impartiality, coupled with basic justice and fairness are important ingredients  when hearing this case…..I was just musing.

And certainly, to show impartiality, judges who have not played a role in any part of the Perak matter will be seen to have this characteristic. Yet

Sri Ram, who was the most senior judge in the Court of Appeal prior to his elevation earlier this year, is  known for his bold and reputed judgment in the Vincent Tan vs MGG Pillai case. His judgments are highly respected and have been used as guidelines for the lower courts. One of his well-known judgments was in the Metramac case where in his decision, he implicated corporate figure Abdul Halim Saad, and former Finance Minister Daim Zainuddin, in having to pay damages to Fawziah Holdings Sdn Bhd.

Sri Ram remains a highly respected judge who is not only held in high regard by lawyers but the public as well but he is deemed not QUALIFIED,

Similarly not qualified seems to be the Chief Judge of Sabah and Sarawak, Justice Malanjum, who is the youngest to be appointed to the post, and is seen as one of the better judges who is not only sharp but delivers excellent writen judgments.

Justice Malanjum was the only dissenting judge on the apex court who sat in the controversial Lina Joy conversion case.

So who are the CHOSEN FIVE? Definitely not Enid Blyton's FAMOUS FIVE!

HERE'RE SOMETHING FOR YOU FIVE TO THINK ABOUT
Justice is conscience, not a personal conscience but the conscience of the whole of humanity. Those who clearly recognize the voice of their own conscience usually recognize also the voice of justice.
Alexander Solzhenitsyn
The paradoxical -- and tragic -- situation of man is that his conscience is weakest when he needs it most.
Erich Fromm
The person that loses their conscience has nothing left worth keeping.
Izakk Walton
Cowardice asks the question, 'Is it safe?' Expediency asks the question, 'Is it politic?' Vanity asks the question, 'Is it popular?' But, conscience asks the question, 'Is it right?' And there comes a time when one must take a position that is neither safe, nor politic, nor popular but one must take it because one's conscience tells one that it is right.:
Martin Luther King Jr
Conscience is the chamber of justice.
Origen

How can we make all these postings and comments be made available to the five judges. Else they will get the impression that the rakyat likes their decisions.

“In a constitutional democracy the moral content of law must be given by the morality of the framer or legislator, never by the morality of the judge.”

As a reminder to our Muslim judges:

Narrated Buraydah ibn al-Hasib: The Prophet (peace_be_upon_him) said: Judges are of three types, one of whom will go to Paradise and two to Hell. The one who will go to Paradise is a man who knows what is right and gives judgment accordingly; but a man who knows what is right and acts tyrannically in his judgment will go to Hell; and a man who gives judgment for people when he is ignorant will go to Hell.

nizar is a dead duckie with these five judges deciding his future. it is a foregone conclusion ... the apex court decision that is. the judges will weave this way and that to come out with a decision against nizar. no point appealing against their professional conscience... they are supporters of U Must Not Oppose party and there is no way they will act impartially. keep fighting Nizar, next GE coming, the voters will vote out these scumbags.

I am sorry to say that it is very frightening to live in Malaysia nowadays with this sort of Justice. This is made worse with the double standards of the police and government. An innocent person can be easily and legally be "made" guilty and a guilty person can be "made" innocent. All depending on connections. This is a sad day for justice. And for Malaysia. And Malaysians.
