SPENT, SINKING, STRECHED OR SCARED?

Last night, the Special Bunch were guests of honor at a dinner hosted by a supporter. We did a spiritual SWOT analysis that we hope to put into good use in PENANTI.
However, there is a chance of a no contest as the BN are already giving loads of excuses that by-elections are draining the coffers and their spirit. We never asked them to give out instant noodles during buy-elections. We never asked them to bring in 6000 police and 4 helicopters. The people are not armed and at every by-elections the show of might intimidates the citizenry and give the chilling impression that war has been declared. We never asked BN to make "donations" to the Press. Fact is, the BN machinery is a spent force and KD Bee End is sinking into the deep end.
Their resources are dismal compared with the motivation and drive exhibited by the DAP, PAS and PKR. At their ceremahs, the played the same record - Saiful Swearing, Hudud and Treason. They used their resources to intimidate with tear gas and road-blocks. They are aware that they are stretched ......and it might well SNAP if they go into Penanti. Resources, like condoms, cannot be recycled or their lose their elasticity and stretch. Faham?

But the general feeling is that BN is scared to contest in Penanti. Why don't they give Samy Velu a chance to contest there. That would be a damn sure way of shutting him up forever. Not a bad idea huh Moo-hee-din?

Even if Penanti is Low Risk, BN will not dare not take the risk unless the EC can come up with some "tactical moves" like limiting the number of supporters at Nomination Day,have Polling day on a working day (although this trick did not work) and maybe Polling to start at 4:00am in the morning. That would be cooler and just nice for breakfast after one has cast one's vote.

  2. How can the people now wholly support PR, when PR demonstrate insensitivity towards Public Resources, wasting time and money, creating one by-election after another just for the sake of , well I don't what!

    1. Wan Azizah simply to make way for Anwar because its a safe haven.

    3. Fairus selfish need for his another further studies, or was it some quarry scandal. Now also threatening to make exposē? Not so clean after all eh?

    My prediction, Anwar will be next, come July...

  3. Although a bit tired from recent by-elections and especially in Bkt Gantang which I physically help out also, I'm itcing for more especially after the F.court ruling on Perak legislative.
    I think they can't take another slap in face anymore.
    PR confident yes, but don't be complacent.

    Unlike all the Babi Negara ( BN ) found quilty of corruptions and indecent behaviour, yet still could be youth leader, party leader, mp, ministers...

    My predidtion, a by-election for pekan will make our day... That too will be truly awesome!!!

    You qouted 3 reasons. Well done! But I can give you, like, 8,756,654,025 events of BN so-called 'leaders'. Are you a true rakyat? My guess is....NOT.

  7. Can Anon7:31PM explain why he is practicing double-standards?

    1. I guess your memory is failing you. Wasn't the March 08 election date chosen especially to prevent Anwar from participating in it? Anyway, this would not have happened if BN was following most other countries in that elections are at fixed dates! 5 years' legislature is just that. How much money has BN wasted over decades of early dissolution to suit their own agenda? The US has been holding elections on the same dates every 2 or 4 years for centuries now.

    2. Jury's still out on the reason for Arumugam's resignation. BN demonstrated in Perak they can use all the powers given by the people to force YBs out of their way.

    3. We wished some BN leaders either officially found guilty of corruption (Ali Rustam, Khairy Jamaluddin, etc.) or heavily suspected (ex-Disney MB Khir Toyol, current PM Najib Mongolia and the many military commissions) would follow Fairus's lead when implicated into serious scandals.

    For your info, as Uncle Zorro said, by-elections' total costs should only cost a few hundreds of thousands, IF BN simply followed the rules. This includes: no need to move thousands of cops, no need for choppers, no need for JKR to tar roads overnight, no need for MECD to distribute millions, no need for Muhyiddin to try to corrupt non-Malays with millions for vernacular schools, etc. Please read MAFREL (http://mafrel.wordpress.com), which explains this very well.
    We all know the actual reason for Najib's reluctance is the likelihood of yet another for the once-indomitable BN. By the way, when is Najib going to seek an actual popular mandate for his position? Likewise for Zambry? Looks like BN is afraid of voters now.
    There's a lot to criticize PR for, but I am afraid not here. You exposed your BN agenda way too easily. The Rakyat will support PR so long as BN behaves like they own this country. BN supporters like you and leaders like PM and DPM still fail to understand this simple thing, which means BN's only future is in the Opposition.

  10. Since some have touched on Perak, here is a legal perspective on the matter.

    Zambry dan enam ADUN BN tidak boleh hadiri sidang DUN Perak — Mohamed Hanipa Maidin

    APRIL 18 — Saya sedar ramai yang ingin tahu kesan keputusan Mahkamah Persekutuan pada 16 April lalu yang memutuskan bahawa keputusan V.Sivakumar, Speaker Perak menggantung dan melarang Zambry dan enam Exconya hadir di DUN Perak selama 18 bulan dan 12 bulan adalah terbatal dan tak sah.

    Ramai yang bertanya saya adakah keputusan tersebut bermakna Zambry dan enam exconya kini boleh menghadiri sidang DUN Perak?

    Jika kita melihat kenyataan peguam Umno dan laporan akhbar pro-Umno seperti Utusan Malaysia (April 17) mereka dengan tidak bertanggungjawab menyatakan bahawa Zambry dan enam exconya kini dibenarkan menghadiri sidang DUN Perak yang mungkin akan diadakan dalam masa terdekat.

    Sebagai salah seorang peguam yang terlibat dalam kes tersebut, saya menasihati rakyat agar tidak terkeliru dengan kenyataan peguam Umno dan laporan akhbar Umno tersebut. Banyak yang mereka sembunyikan dan tidak jelaskan tentang apa yang sebenarnya berlaku di Mahkamah Persekutuan pada tarikh tersebut.

    Marilah kita mulakan dengan melihat apakah perintah-perintah yang dipohon oleh Zambry dan enam exconya di dalam saman yang mereka kemukakan ke atas Sivakumar di Mahkamah Tinggi dan kemudiannya didengar di Mahkamah Persekutuan.

    Sebenarnya Zambry telah memohon sepuluh (10) perintah Mahkamah dan dari sepuluh perintah tersebut Mahkamah hanya membenarkan dua (2) perintah sahaja. Dua perintah yang dibenarkan oleh Mahkamah adalah seperti berikut:

    Pertama, perintah membatalkan keputusan Sivakumar yang menggantung dan melarang Zambry hadir di DUN Perak selama 18 bulan.

    Kedua, perintah membatalkan keputusan Sivakumar yang menggantung dan melarang enam exco Zambry untuk hadir di DUN Perak selama 12 bulan adalah terbatal dan tak sah.

    Lapan permohonan Zambry tidak dilulus Mahkamah.

    Itu sahaja dua perintah yang Mahkamah Persekutuan benarkan pada 16 April lalu. Tidak lebih dari itu. Apa sahaja kenyataan dari peguam Umno selain dari dua perintah tersebut bukanlah perintah Mahkamah sebaliknya adalah kenyataan mereka yang tidak berasas.

    Memandangkan Mahkamah Persekutuan hanya membenarkan dua perintah di atas, adalah jelas Mahkamah tidak membenarkan lapan (8) perintah lain yang juga dipohon oleh Umno dan dihujahkan oleh para peguam Zambry dan pasukan peguam Sivakumar.

    Apakah perintah-perintah yang dipohon oleh Zambry dan enam exconya tetapi tidak dibenarkan oleh Mahkamah Persekutuan? Mari sama-sama kita saksikan lapan perintah yang TIDAK DIBENARKAN tersebut.

    Meskipun peguam Umno berhempas pulas dan bermati-matian berhujah, Mahkamah Persekutuan TIDAK MEMBENARKAN perintah-perintah berikut:

    1. Perintah untuk Mahkamah mengisytiharkan bahawa keputusan Sivakumar (defendan pertama di dalam kes tersebut) menggantung dan melarang Plaintif Pertama (Zambry) menghadiri pada sidang DUN selama 18 bulan adalah ultra vires (bertentangan) dengan Undang-Undang Tubuh Negeri Perak, Perintah-Perintah Tetap Dewan Perhimpunan Undang Negeri Perak (standing orders) dan Enakmen Dewan Perhimpunan Undangan (Keistimewaan) 1959 dan/atau undang-undang yang berkaitan dan oleh itu adalah terbatal dan tak sah.

    2. Perintah untuk Mahkamah mengisytiharkan bahawa perbuatan Sivakumar menggantung dan melarang Zambry menghadiri sidang DUN selama 18 bulan adalah menyalahi undang-undang.

    3. Perintah untuk Mahkamah mengisytiharkan bahawa keputusan Sivakumar menggantung dan melarang Plaintif ke-2 hingga Plaintif ke-7 (enam Exco) menghadiri sidang DUN selama 12 bulan adalah ultra vires (bertentangan) dengan Undang-Undang Tubuh Negeri Perak, Perintah-Perintah Tetap Dewan Perhimpunan Undang Negeri Perak (standing orders) dan Enakmen Dewan Perhimpunan Undangan (Keistimewaan) 1959 dan/atau undang-undang yang berkaitan dan oleh itu adalah terbatal dan tak sah.

    4. Perintah untuk Mahkamah mengisytiharkan bahawa perbuatan Sivakumar menggantung dan melarang enam Exco menghadiri sidang DUN selama 12 bulan adalah menyalahi undang-undang.

    5. Perintah untuk Mahkamah mengisytiharkan bahawa Zambry dan enam Exconya adalah berhak menghadiri dan mengambil bahagian dalam semua sidang DUN dan menjalankan segala fungsi dan kewajipan mereka di dalamnya.

    6. Perintah untuk Mahkamah mengisytiharkan bahawa DUN Perak adalah tidak terikat dengan keputusan Sivakumar menggantung dan melarang Zambry dan enam Exconya menghadiri sidang DUN Perak.

    7. Perintah untuk mengisytiharkan bahawa DUN Perak adalah tidak terikat dengan apa-apa arahan, perintah dan/atau petunjuk Sivakumar yang berbangkit daripada atau berhubung dengan keputusan Sivakumar yang bertarikh 18 Februari, 2009.

    8. Perintah-perintah, perisytiharan dan/atau relif lain yang difikir suaimanfaat oleh Mahkamah.

    Sekali lagi saya ingin tegaskan di sini bahawa lapan perintah di atas yang Zambry dan enam exconya pohon TIDAK DIBENARKAN oleh Mahkamah Persekutuan.

    Atas dasar itu jika peguam Umno atau akhbar pro-Umno mengatakan bahawa Zambry dan enam exconya boleh menghadiri sidang DUN Perak, jelas kenyataan itu bukan datang dari mana-mana perintah Mahkamah sebaliknya ianya hanya kenyataan tidak berasas dari peguam Umno dan akhbar mereka.

    Kenyataan tersebut tidak mempunyai apa-apa nilai di sisi undang-undang. Rakyat tidak perlu melayan kata-kata mereka yang dibuai khayalan tersebut.

    Bagaimanakah Umno boleh mengatakan keputusan tersebut bermakna Zambry dan enam Exconya boleh menghadiri sidang DUN Perak sedangkan Mahkamah dengan secara jelas tidak membenarkan perintah yang mereka pohon iaitu perintah bahawa Zambry dan enam exconya adalah berhak menghadiri dan mengambil bahagian dalam semua sidang DUN dan menjalankan segala fungsi dan kewajipan mereka dalamnya.

    Kalau perintah tersebut dibenarkan oleh Mahkamah Persekutuan barulah mereka boleh mengatakan Zambry dan enam exconya boleh ke sidang DUN Perak.

    Saya harap penjelasan di atas sedikit sebanyak dapat menjelaskan bahawa apa yang Umno kata di media massa adalah tidak menggambarkan apa yang sebenarnya berlaku.

    Sivakumar masih Speaker dan beliau masih berbisa. Jika Umno terus mengeluarkan kenyataan mengelirukan tidak mustahil mereka mungkin akan dipatuk oleh Sivakumar dan saya percaya patukan selepas ini akan membuat Umno menderita lebih panjang.

    Saya juga ingin tegaskan di sini apabila Zambry dan enam exconya membawa kes mereka di Mahkamah dengan mencabar keputusan Sivakumar sebagai Speaker yang sah, mereka mungkin tidak sedar bahawa mereka sedang melakukan satu kesalahan kerana mendedahkan dokumen-dokumen rasmi DUN Perak tanpa mendapat kebenaran terlebih dahulu dari Sivakumar sebagai Speaker.

    Marilah kita sama-sama tunggu dan lihat apakah yang berlaku selepas ini.

    Correct me if I'm wrong, the court disproved the eight perintah, but this disapproval does not contradict nor deny the 2 perintah. The way I see it, the 8 were redundant and unnecessary, which in the end favours zambry.

    The 2 perintahs now hold. So what is going to stop zambry next?

    All those 8million plus or whatever, were seen in court, we have seen BN reps come and go. History shows, but you seemed to have failed to note, BN has no problem rejecting those character. I don't have to exaggerate like 8 million plus list, but enough to see people like the ex no.1 pak lah toppled, no2 anwar dismissed, etc. Unlike BN, DSAI whom is awaiting a court criminal case is still being worshipped by PR after so many drama and lies, after lies, after April 08, May 08, July 08, then with all suspense of Sept 16, then within 48hrs, then by raya haji .....PR supporters still believe this serial LIAR. Wish that death threat is real so he can remain in Turkish embassy forever!!

  16. There is a solution to end all these by/buy election once and for all.
    Why not Anwar and najis resign their MP position and recontest in a more neutral ground.
    I think Bukit Bintang constituency will be good for both of them .
    Why not? najis is well known in Bukit bintang ( for toilets ).
    And najis seems to be passing by BB nearly daily .

    Najis has only the batang left and no more balls lah...perhaps, they should get Koh to contest, since Gerakan is talking so much.

  21. BN's latest ruse to scream that by-elections are a waste of money is really a big joke. I am sure that the by-elections have benefitted the local residents in the various constituencies involved immensely in terms of increased hotel occupancies, full house each night in the food outlets, restaurants and pubs for the duration of the campaign period and of course culminating in the victory celebration at the end of the election.
    Without doubt, it is the best form of stimulus package in the current slowdown in the economy and it benefits the lowly man in the street directly.Contrast this with the mega Projects that are given out to the BN crony companies where less than 1% of the contract sum surfaces in the locality. All those companies source their materials in KL and all their sub-contractors also are from KL. The only money spent in the locality are the food eaten in the towns there. Sometimes, they build their own accomodation and do not even rent houses for their staff.
    I therefore strongly recommend the holding of by-elections regularly to boost the economy in places away from KL.
