    we think that the act of putting people in jail with them not having ACCESS TO JUSTICE is wrong.

    terrorists should come to judgement too. because you see if they ever took over the country, would you not want access to YOUR lawyer if they put you in Kamunting? an extreme example for one who seems to need one.

    you see, dear.. we're trying to have some form of dignity in this country. a standard we're all proud of.

    it takes men and women with principles to run the justice system in this country. if we put everyone in the bin at some clown's behest, we run the risk of becoming like Malaysia.

  2. Simple, if those guys are indeed terrorists, then why doesn't the government charge and prove it in the courts instead of wasting 7 years of their life?? If they are indeed found to be guilty, then give them the maximum punishment available.

    What's the point of having courts and judiciary system if we are not planning to charge criminals and prove their crime? Might as well abolish them courts and judges right, at least we can save on wages. Yes Kamal Barsha, lets stick with ISA, but abolish the rest of our judiciary system.

  4. If you have the proof, charge them in court. That's what our Constitution says.

    The ISA is an UNCONSTITUTIONAL law because no probable cause is required and the Minister is given abolute power over individuals which can and does lead to untrammelled abuse. The fact that Parliament passed it does not make the ISA legal.

    If you have NO proof, then you MUST release them (they should not have been arrested in the 1st place) and then make sure you have a Class-A surveillance team to watch over them until you get the proof.

    That's how a JUST system civilized country should work.

    Here's what the strugle is all about:

    English: Abolish ISA and let the detainees have their day in court for their alleged crimes.

    B.Malaysa: Mansuhkan ISA dan hadapkan mereka ke Mahkamah untuk dibicarakan.

    No one is fighting for them to be declared innocent and to be released home. Alleged criminals are still innocent until proven guilty. If one has created some form of crime, then he should be detained and charged in the court of law and punished accordingly if found guilty. we are only asking for the government to abolish the ISA and let all these detainess have their day in court. Wanna join us?

Say wrong place at wrong time. did you not want to bring him / her to court to prove him / her innocence and free him /her??? or let your love ones rot in jail because ISA is good. what will you do?? Im sure every detainees have love ones?? If they are guilty, there are laws to punish them..

    Came across an interesting comment to an article from Lazarus, the comment from this character NAL WAS A eyeopener to the antics of indoctrination of BTN, go and read for yourself how full of it this guy is, but there was a rejoinder which will shut him up though, even if I say so my self it was preety good.

    I am sure most Malaysians have not forgotten those dangerous avtivities of the JI members esp the merciless killing of those two brave policemen who were tortured to death.
    In a democratic country like Malaysia as claimed by our govt,the ideal thing to do is to try these elements in an open court and mete out the maximum punishment according to the law.Thats why we have courts,lawyers and judges.
    ISA has no place in a civilized society as this is a draconian and a merciless law being used by those who walk the coridors of power to quell dissent and to inflict pain and sufferings on them and their families too.
    You argued that those JI elements could be freed on technical grounds.Well ,I believe that is not possible as their act of terrorism has been well documented and there are also sufficient evidences to be adduced as well as enough witnesses who would be willing to take the witness stand.Lets say you are right,then the PDRM should mobilize their intelligence unit to keep tab on their activities,isn't it their duty to do so?
    Remember this,one may allow 100 criminals to go scot free on whatever ground,but it is a big sin to even detain one person without proper trial and be allowed the right to defend him/herself.This is exactly what we as right minded Malaysians are trying say to the govt.and repeal this merciless flinstone law.
    I believe if you had taken a few minutes to ponder before jumping the gun you could have deciphered this simple message from thousands or should I say millions of right minded Malaysians and you could have avoided branding us as IDIOTS.

    Give them a chance to defend themselves in a open court. There is no such thing as denying basic human rights in the 21st century. It's also surprising to note we still have some peculiar people who say the rabbit they hold has only 3legs.

  35. I do not object any laws that are good for our national security, be it ISA, OSA, AUKU or any other laws. But I am against injustice and abuse of power. There is nothing wrong to detain a person for two years. Go ahead, incarcerate him. But it must be done in a fair and just trial. Detention,rehab or any information extracting measures are all considered sentences. And it should be passed accordingly by a court of law.

    But ISA lacks all this avenue. You can be detained indefinitely by the authority of 1 person.How would you know that this person didn't do it out of his personal interest? And since it is a one man decision, it is subject to abuse in every possible ways.

    ISA and the Emergency Ordinance was passed to thwart the Communist insurgent. It was at that time,viewed as necessary. But bear in mind that in that time there was an ongoing war between capitalism and communism. In western bloc, communism is painted as a threat and vice versa. Out of fear, people suspected of being a communist or capitalist in both worlds have been incarcerated,shot,hanged,tortured and humiliated. All of this is in the name of National Security. But in reality, it is done to protect the lifestyle and the government itself, and to be specific, to protect those who are in office.

    National security must take into account the security of the majority of us, not just a few bloke.And it must be done in a fair and just way. We can do away with the ISA and EO. There are no more commies here my friend. Just you being afraid of the dark...

    I do not attempt to justify this but there is at least one significant difference between the US Patriot Act and Malaysia's ISA and that is the US Patriot Act has a finite existence wheareas the Malaysian ISA is evergreen.

    Patriot Act was originally due to expire Dec 2005 but has been voted on to extend most of its provisions to end in Dec 2009.

  38. Just from reading the comments here, it is clear that everyone understands what we are asking for - except this poor dude! I wonder how he'd feel if he was thrown in jail under the ISA and has no recourse to anything - lawyer, family, justice.

    If these guys are really the terrorists he's so afraid of, it should be no problem dealing with that in court. Why do we need to use the ISA if we have the evidence against them?

    Generally, most laws are good laws until abused. This law is the one exception to this rule.

    If the gomen is so sure that they are terrorists enough to lock them up for so many years, why not just proceed with charging them in the court and confirm their status and judgement?
    Why should certain individual in the gomen be allowed to play god and judge ?
    What if you Kamal is the one arrested and jailed under ISA without a trial and being accused of threatening the security of the country and have to spend 2 years in jail? You may be innocent but who cares? Won't you be crying for justice? Won't you want to be able to claim trial?
    ISA forfeits your rights absolutely. Sigh....I wonder why I am bothering to educate you Kamal.
