Blogger and author of Tiger Isles, Donplaypucks picked me up at Bangsar LTR station at 720pm enroute to the Royal Selangor Club. It is 2;23am, but I have to say this…..the crowd assembling and OCCUPYING Dataran Merdeka and its surrounding roads, despite it being declared illegal, reminded me of the eve of Bersih3.0. The message by a significantly young assembly is quite stridently clear….BN start counting your days.

BTW, the petty traders did a rip-roaring business minus ikan bakar!

BTW again…..the Special Bunch gathered….complete with our official chauffeur and Minister of Grub…..GUS GAN!

The cabinet has accepted a suggestion to reprimand three key BN leaders, Deputy Higher Education Minister Saifuddin Abdullah, Deputy Youth and Sports Minister Gan Ping Sieu and Umno Youth chief Khairy Jamaluddin. for their open objection to Section 114A of the Evidence Act 1950. This was dessert topic after brunch a few hours ago. Glaringly no MIC rep was a conscientious objector, it was observed.

Preceded by some vituperative Indian expletives I have never heard before, Raji exploded: Fat chance UMNO’s blue-eyed hand-kisser Kamalanathan can stand upright to be counted!

AL FATIHAH AUNTY!

This morning we had news that Aunty Nga passed away in Melbourne. Over two decades I have never missed Hari Ray with the Yasin family. This year, Aunty and Datuk Yasin celebrated Hari Raya with their family in Adelaide and Melbourne.
They were to return to KL but Aunty would not have wanted it any other way…..to go when those whom she loved were around her. She passed away peacefully in Faridah’s arms.

THERE WAS THIS THING CALLED THE IPCMC?

In 2006, as the government mulls over its decision to implement the Independent Police Complaints and Misconduct Commission (IPCMC), the police force has on the other hand launched a campaign to step up its rejection to the proposal.

In a special edition of an internal bulletin Berita Bukit Aman, the Royal Malaysian Police (PDRM) attacked the IPCMC among others as 'unconstitutional, prejudicial to national security and public order, can cause a state of anarchy and undermines the ruling coalition's power'.

The bulletin also warned that if the IPCMC is established by the present Barisan Nasional-led government, the police force will vote for the opposition in the next general election. Full story HERE.

Citing statistics provided in Parliament, Kapar MP S Manickavasagam said that from 2000 to 2009, 279 people had been shot dead by police, the majority of whom were Indonesian nationals.

The written reply by Home Minister Hishammuddin Hussein said this is in accordance to the Criminal Procedure Code and the Inspector-General of Police Standing Order.

However, Subang MP Sivarasa Rasiah said the figure could be understated.

“In 2008 alone, police figures state that 27 people were shot, but human rights NGO Suaram documented at least 44 cases that year alone (as) published in their documents.

“The Human Rights Party which also monitors this, found 82 cases the same year."

WHO BOSSES THE TRIADS?

A few evenings ago I received this SMS: 60 accounts executive from Price Waterhouse Coopers are currently stationed at the PM’s Department to troubleshoot issues affecting government projects and also proposing to turn around their projects.

My response: PWC can station their whole troop for all I care. They have become a joke after their involvement in the crime index fiasco. Massaging and manipulating are now synonymous?

Jiminy Qrikert: Just imagine what this does to the morale, self-image and honour of the police force.

These are the men and women who are faced with the increasing barrage of reports of crime but are forced to be a part of this huge lie and succumb to the political pressures to doctor data to prop up their political masters.

They know it's a lie but are helpless to prevent it. At the same time, they see the extent of corruption committed by these political masters who are powerful enough to literally get away with murder.

It does not take much pushing or temptation for these police to also succumb to crime and corruption since you might as well join them if you can't beat them.

No wonder, Umno-BN is so deeply buried in corruption as the police are now guilty accomplices in spinning a crime into a non-crime.

Amused Malaysian: Why crime statistics only. What about Hari Raya road fatalities? There's none of the fuss of previous years. Don't tell me there are no road fatalities this Raya.

(Just wondering if PWC has morphed into a government SPA…..massaging the dead to live again…..kudos to JPJ for a deathless balik kampong record!)

Kgen: It is not uncommon to massage figures to portray a better picture but this has been carried too far so much so that reality and statistics move in opposite directions.

This is when the strategy backfires as the public totally rejects the said statistics. Yet the government still insists that crime is a perception problem because its statistics say so. This is an insult to our intelligence.

What government think-tank Pemandu is doing is like trying to sell ice to Eskimos by saying that the natural ice around them is a false perception.

Well, Mr IGP (inspector-general of police), your brilliant little scheme has been found out. You had Pemandu fooled completely but not us, the suffering public who has first-hand experience of crime.

Please don't insult us by saying ‘perception' again and that goes for that loudmouth home minister who grudgingly said police will focus on fighting crime as if that is something extraneous for them.

STILL INVINCIBLE AND UNTOUCHABLE?

Mat Zain, former senior police officer, states there is no other body that is qualified to adjudicate on the present attorney-general than a tribunal.

He said Najib had last March rejected the calls for a tribunal although many credible exposures had been made over Gani’s misconduct in the public domain.

“I placed my trust on the PM to reconsider that stand. If Najib was willing to have an RCI to investigate the influx of illegal immigrants into Sabah, then he should consider the wishes of the people in the peninsula who had asked many times for a tribunal to be formed against Gani for the alleged misconduct,” he said.

Mat Zain Ibrahim, in his open letter sent to Najib two days ago, also revealed another possible misconduct by Gani with regard to documents relating to Anti-Corruption Agency (ACA) investigations into the bank accounts of former Malacca chief minister Rahim Tamby Chik.

I always thought that nobody is invincible and untouchable except the Almighty! The question that invariably accompanies this would be: What “hold” has the AG on Jib? Something to ponder over the weekend?

1Malaysia Development Bhd’s push into the property sector is raising concerns about the company’s rising debt and a possible commercial property glut in KL.

When it was first set up, 1MDB’s initial capital of RM5bn was raised from 30-year bonds. About RM3.5bn of this was invested in PetroSaudi. It later sold this for RM4.2bn and invested in Murabaha notes.


The Edge weekly (6 August) reported that 1MDB’s total loans and borrowings rose to RM6.8bn (31 March 2011) from RM4.4bn a year earlier. 1MDB then piled on further debt of RM11bn to finance its investment in the energy sector including buying up Ananda Krishnan’s Tanjung assets for a hefty RM8.5bn. (It is now eyeing the energy assets of Genting, Sime Darby and Bukhary’s Malakoff, reports The Edge).

The company is involved in the 70-acre RM26bn Tun Razak Exchange (or TRX – previously known as the KL International Financial District) – 25 buildings and a new stock exchange – 20m square feet of floor area. It is supposed to serve as a financial services regional hub.

The Edge also reported the firm had pumped in RM194m into properties (70 acres for TRX and 484 acres of the Sungai Besi air force base in KL) but these are now revalued at RM826m! How did this happen?

Both TRX and Bandar Malaysia will require RM5.4bn funding for the first phase. Now where is 1MDB going to raise the money from? The government or state-managed funds?

In the process a new word enters our lexicon – subsidies is now replaced with INCENTIVES!

SOME HEAT FROM UTAH.

“Passing a law loaded with bias to benefit one particular ethnic race is a serious flaw, especially when it is woven into the fabric of a supreme law called a constitution. The interests of other communities, according to the extreme flaw in our supreme law, quickly evaporates. I wonder if the Reid Commissioners were drinking cheap toddy, or smoking inferior weed, when they thought this through, and ultimately writing it in stone,” wrote Judge Navin Naidu, Founder and Law Professor at Constitutional Law College, Greater Salt Lake City, Utah, USA.

As of Dec 27, 2007, the federal constitution has undergone more than 200 constitutional amendments. The amendments to the judiciary are devastatingly loathsome. Naturally, Article 153, however, is untouched, and still in the pristine condition it was originally penned to entrench more than affirmative action.

I wonder if the regime change post-GE13 will amend, or commend, Article 153. Will amending Article 153 become the Malaysian dilemma with a good measure of a counter-dilemma to accommodate the legitimate interests of all races?

EVEN IN THE ARTIC THE HEAT IS FELT!

My regular reader Manjit who resides in Finland directed me to a posting he put up in Najib’s Facebook. His posting lasted just a few minutes before it was taken down. Anyway here it is:

I just sent this out to the P.M Najib of Malaysia on his FB page . Lets see if I will be seeing the Raya in a cell. "Mr. Prime Minister I come from a family of govt. servants tracing back our roots to 1843. My ancestors have been soldiers and in the Police force my dad being the only exception being a Electrical engineer with LLN/TNB. This tradition has been carried on by our youngsters, my great grand nephew is today in PARA 2 with the British army in Afghanistan.

REVISITING WISCONSIN

I find the statement by your cousin Home Minister Hishammuddin Hussein ONN (HERE)rather disturbing. My family have always been supporters of BN but what your cousin stated has put a lot of us in rather foul mood. If you have people like him making statements like this without using his brains than you do not need Pakatan to beat in the next Elections, you have your own clowns in BN making silly statements like this who will make you lose votes. Does he mean to say that all this while the Police force have been just giving out parking tickets and directing traffic since Merdeka? So botak Chin shot himself in the head, the gangsters and triads which were the bane of KL in Bukit Bintang just retired due to old age and just gave up their bad ways> they repented due to their conscience? Either Home Minister Hishammuddin Hussein Onn is a moron or he is a retard and it is time you replaced him with somebody who actually has brains to handle the tough job of being a Home Minister. We the descendants of the Armed forces and Police force are owed a huge apology from G.O.M. You mean to say to all the widows of Police Personnel which includes my relatives that their Men and women who shed blood, tears and life were just main main? Home Minister Hishammuddin Hussein statement is a total insult to their memories and to Malaysians who have stood fast and defended this nation. Please make that clown of a home minister to retract his silly statement, if it was coming from Ibrahim Ali or Bung Mokhtar we can accept it as they are clowns but for a person who has supposedly studied Law it is a joke!

I know it is Hari Raya, so Selamat Hari Raya pudichot Sham….could be your last as Minister when you pull down your cousin come GE13….fat chance you will “shake down the thunder from the sky!”

NO MIRACLES NEEDED.....JUST AN X WHERE IT MATTERS!

“Malaysia will become a fully indebted nation before the end of the decade at the current rate of massive borrowing and irresponsible spending by the BN Government” declared the Malaysian Institute of Economic Research (MIER).

I usually do not write about such things on the eve of Hari Raya or any of our festivals. But there comes a time when raw reality supersedes sentimentality. Over a Chinese New Year visitation I heard this within earshot. This 5 year old kid on discovering the contents of his angpow told his 7 year old sister: “That aunty’s angpow only 1 ringgit.” I snatched the red packet from Benjy and said, “I know a very poor boy who would value this 1 ringgit to share with his younger sister.” He ran to his mother to complain and the latter gave me a look! So what? Later, I learnt from the father Stanley my former student that Benjy was disciplined appropriately in the presence of the mother and sister. BTW Benjy emails me from Melbourne more regularly than my two kids! Howzat!

The beautiful thing about this balik kampong phenomenon is that irrespective of which festival, siblings take the opportunity to head for home-base. What better opportunity to impress on those still unimpressed that this is not a tale but a sorry fact that has to be put on the table. This is an opportunity to level with our doubting parents or siblings. Here are the bare facts from MIER no less that Malaysia will Go Bankrupt By 2019 With Debt To GDP Ratio Of 100%:

The Federal government debt to GDP (Gross Domestic Product) ratio has increased yearly from 53.1% in 2010, 53.8% in 2011 and 54.8% in 2012. This is extremely alarming and nearly touching the national debt ceiling of 55%. According to Malaysian Institute of Economic Research (MIER) fellow Mohd Ariff Abdul Kareem, if the Federal Government continues to borrow at the current rate, our debt to GDP ratio will be 100% of GDP by 2019! In absolute terms, Federal Government debt rose by 71% in 4 years to RM456 billion at end 2011 from RM266 billion at end 2007. At the same rate of expansion, our national debt will be RM780 billion by 2016, and RM1.3 trillion by 2020. Mohd Ariff also noted that what is more worrying is that our rate of borrowing is far outpacing our economic growth, so much so that he was quoted as saying, "If nothing is done to reverse the current trends in government expenditures and revenues, extrapolation suggests that Malaysia's national debt will explode to 100 per cent of GDP by 2019." This is extremely dangerous, and even more disastrous when coupled with statistics from Bank Negara's Annual Report 2010, which revealed that Malaysia's household debt at the end of 2010 was RM 581 billion or 76% of GDP, thus giving us the dubious honour of having the second-highest level of household debt in Asia, after South Korea. In addition, the Malaysian household debt service ratio stood at 47.8 per cent in 2010, meaning that nearly half of the average family's income goes to repaying debts. Not only are Malaysians debt-laden, cost of goods are also skyrocketing while income and salaries have stagnated. While infant milk powder has risen by nearly 50% in recent times, other basic commodities have also gone up by leaps and bounds, such as: 1. Sugar: RM1.45/kg (Jan 2010) to RM2.30 (May 2011) - 58% in 18 months. 2. Eggs: B grade RM9/30eggs (sept 2010) RM10/30eggs (now). 3. Electricity tariff: average increase of 7.12% in June 2011. 4. The tarik and kopi susu: increase RM0.10 to RM0.20 (9.1% to 18.2%. 5. Gardenia bread: 5%-14% hike (2011). 6. Service tax increase 1%: additional RM720 million in taxes to Federal Government. 7. Onions: price up 17% (Dec 2010). 8. Milo: up 5% 1st half 2011; 4% 2nd half 2011. 9. Nescafe: price went up further 6% in 2nd half 2011, when price is already >RM20 per 300gm 10. Favorite food items like roti canai, char koay teow and nasi kandar come in smaller portions for the same price. In contrast, Pakatan Rakyat-managed states have successfully managed their finances and not overburdened the people with debts. In fact, Penang managed to reduce state debt from RM630 million at 8 March 2008 to only RM30 million as at end of October 2011. This represents a debt reduction of 95% or RM600 million, which is the highest debt reduction of any state in Malaysia's history! Clearly, Malaysians who wish to have a better life for themselves and their future generations must make a choice between a government that is spendthrift and that borrows irresponsibly without being able to make the pie grow bigger, or a government that is prudent and transparent that will put the concerns of the rakyat first.

Probably a re-read HERE might help when you discuss this with your family over the festivities.

FRIDAY GUEST BLOGGER: A PIG IS A PIG AND NEVER CAN A TIGER BE.

In a zoo in California, a mother tiger gave birth to a rare set of triple tiger cubs. Unfortunately, due to complications in the pregnancy, the cubs were born prematurely and due to their tiny size, died shortly after birth.

The mother tiger started to decline in health, although physically she was fine. The veterinarians felt that the loss of her litter had caused the tigress to fall into a depression. The doctors decided that if the tigress could surrogate another mother's cubs, perhaps she would improve.

After checking with many other zoos across the country, the depressing news was that there were no tiger cubs of the right age to introduce to the mourning mother. The veterinarians decided to try something that had never been tried in a zoo environment. Sometimes a mother of one species will take on the care of a different species. The only "orphans" that could be found quickly were a litter of wiener pigs. The zoo keepers and vets wrapped the piglets in tiger skin and placed the babies around the mother tiger.

FOREIGNERS CAN BUT HARIS IBRAHIM CANNOT.

A foreigner in possession of a dubious IC was asked by a magistrate in Kota Kinabalu in September 1992 how he had obtained the document.

His answer was: “From a project called Project President Mahathir”.

The foreigner was jailed for two years but upon his release, was not repatriated. Instead, he managed to get registered on the Sabah electoral roll, where his name remains up to now.

Next, in 1998, there was a public hearing to decide if would-be new voters in the Likas constituency should be accepted if there were objections to their registration.

The Election Commission’s registering officer asked how they had obtained their ICs - the answer was “from Project Mahathir”. The registering officer testified to this during the hearing of the 1999 Likas election petition.

Can Sabah repatriate these manufactured citizens now. Yes. They can invoke the Inter-Governmental Committee Report, Chapter III, paragraph 16, sub-paragraphs (f) (ii) and (iii) to ‘expel these new citizens to the peninsula.

After all, this was what it did to activist Harris Ibrahim few months ago, when he was refused entry to Sabah allegedly on security grounds.

CATCH UP ON WEDNESDAY, YAH?


What is Section 114A?

Section 114A is the second of two amendments made to Malaysia’s Evidence Act 1950.

Law Minister Nazri Aziz tabled the second amendment, formally known as Evidence (Amendment) (No2) Act 2012, in Dewan Rakyat on 18 April. James Dawos Mamit supported the motion, and Section 114A was passed after the second and third reading. On 9 May, Dewan Negara passed the amendment.

The amendment was gazetted on 31 July 2012. This means the law is now operational.

What is the purpose of Section 114A?

Section 114A deals with allegedly illicit or harmful content on the Internet. In short, the amendment enables law enforcement officials to swiftly hold someone accountable for publishing seditious, defamatory, or libelous content online.



How does Section 114A affect you?

Titled “Presumption of Fact in Publication”, Section 114A holds the following people accountable for publishing content online:

(1) those who own, administrate, or edit websites open to public contributors, such as online forums or blogs;

(2) those who provide webhosting services or Internet access; and

(3) those own the computer or mobile device used to publish content online.

In other words, if allegedly defamatory content is traced back to your username, electronic device, and/or WiFi network, Section 114A presumes you are guilty of publishing illicit content on the Internet.

But what if you were the victim of identity theft and a hacker wrongfully used your Twitter or Facebook account to post defamatory content?

Under Section 114A, you are still considered guilty until proven innocent.

What is wrong with Section 114A?

Section 114A is problematic for a number of reasons:

i) It disproportionately burdens average Internet users who are wrongfully accused of publishing seditious or defamatory content.

ii) It makes Internet intermediaries–parties that provide online community forums, blogging and hosting services–liable for content that is published through their services.

iii) It allows hackers and cyber criminals to be free by making the person whose account/computer is hacked liable for any content/data which might have changed.

iv) It is a bad law passed in haste and does not take into account public interest and participation.

TOYING OR TREASON?

In the past four decades, the population of Sabah has increased by almost five folds (from 650,000 in 1970 to 3.12 million in 2010), much of it consists of illegal immigrants or their descendants.

Such population implosion has not only created unbearable strain on Sabah's social and economic fabric, but it has also stripped original Sahahans of their sovereignty, in that a large chunk of its present electorate are made up of these illegal immigrants who have been illicitly granted voting rights through a massive clandestine operation known as ‘Project M' (M stands for Mahathir).

In a rare display of judicial independence under former prime minister Dr Mahathir, Justice Muhammad Kamil Awang's judgment (HERE) annulled the Likas election in Sabah in June 2001. Muhammad in his judgment chronicled details of a massive illicit campaign to convert illegal immigrants into voters through the unlawful issue of blue ICs and the unlawful registration of these IC holders into the electoral rolls.

“I tell you, it has come to stage when these PTIs (‘pendatang tanpa izin’ or illegal immigrants) dare to speak out. I hear it every day from the people. When they fight for a place to sell vegetables at the markets, our locals are driven out. Yesterday when our locals fought back and said, ‘this is our country’, these foreigners retaliated and said, ‘No, we will be taking over your state very soon’," said Wilfred Bumburing.

"When our officers reprimand them at government departments, they retort, ‘don’t you be so conceited. Our people will be in your seats soon’. These illegals are costing us our resources, causing health, social problems, they bring drugs and they bring disease to Sabah. But the most important thing is that our sovereignty has been breached and the government has not done anything."

Prime Minister Najib Abdul Razak announced yesterday that the Royal Commission of Inquiry (RCI) into the illegal immigrant problem in Sabah will be headed by former chief judge of Sabah and Sarawak Steve Shim.

The other commission members are former Universiti Malaysia Sabah vice-chancellor Kamaruzaman Ampon, former Sabah attorney-general Herman Luping, former Sabah state secretary KY Mustafa and former Kuala Lumpur police chief Hendry Chin.

Former prime minister Dr Mahathir Mohamad has said that the RCI would serve no purpose and would harm the BN no matter what the the commission's findings were.

“If the findings fall in favour of the government, the opposition will say it’s manipulated and if it is against, the government will get it in the neck,” he said. At least he is aware of THAT part of the anatomy at “stake”!

The RCI announced today will be tasked to investigate the number of foreigners granted citizenship in the East Malaysian state and whether this had been done in accordance with the law. Eight TERMS OF FERERENCE were spelled out. HERE

HOW DOES IT FEEL TO LIE…..SUHAIMI BABA?



YES, go ahead show Suhaimi Baba’s film on May 13. Those of us, me included, who lived through it and who got involved in welfare work resulting from this mayhem will be the correct judges of the veracity of this film. We were all witnesses to how Malaysians harbored and protected each other during the rampage. We will be the judge as to whether this film is to soothe or to incite.

Yes, show the film. When the film has run its intended course, it will be for Suhaimi Baba who will have to answer for whatever result from this film. She will have to live with this lie, if she lied to a generation who was not around when it happened.

Yes, show it as suggested by some UMNO bloggers, during Hari Raya. Big box office bucks for sure! As for me I will herald Hari Raya viewing this clip by Hafiz Ibrahim with my Muslim friends because at the end of the clip I don’t have to ask: Was this an attempt to lie? Was it to inspire or to incite?

STATUTORY RAPE IS RAPE, NO?

As reported by national news agency Bernama yesterday, Noor Afizal Azizan escaped jail when the Appeallate Court allowed his appeal to restore the decision of a Sessions Court which bound him over for good behaviour for five years, in a sum of RM25,000 for statutory rape.

The three-member bench led by Court of Appeal president Raus Md Sharif unanimously set aside the five-year jail term imposed on Noor Afizal by the Malacca High Court in allowing the prosecution's appeal for an enhanced sentence.

Raus, in his decision, agreed with counsel Hisyam The Poh Teik that public interest would not be served if Noor Afizal was sent to jail as he had a bright future.

He is not even named in this Gemilang 2010 squad! Maybe his is just tapping on the door!

Bright future as defined by law or perception. We are told repeatedly that nobody is above the LAW. But this is Bolehland. YES!

What of the girl’s future?

This reminded me of what did happen to Guan Eng when he defended a young maiden also from Malacca. Dang!

The court failed to define “good behavior”….any suggestions?

Prime Minister Najib Abdul Razak announced today that 1Malaysia Development Bhd Foundation will extend RM100,000 in aid to the family of Alleycats band member A Loganathan, whose house was razed recently.

Speaking at a Women, Family and Community Development Ministry event with the underprivileged, he said this was to appreciate the late Loganathan's (right) contribution to the arts and the nation.
